The European Commission decided to start procedures of finding failure to fulfill obligations by sending letters of formal notice to France and Romania, asking them to bring their national legislation fully into line with EU road infrastructure safety legislation, a press release from the EU executive informs.This letter of putting in default represents, in fact, the formal starting of the infringement procedure.Directive 2008/96/EC on road infrastructure safety management, as amended by Directive (EU) 2019/1936, lays down measures to take into account the safety of vulnerable road users (pedestrians, cyclists and motor vehicles) in all road safety procedures, from the initial impact assessment of new road projects to regular inspections of built infrastructure. In addition, the directive requires the most dangerous infrastructure sections identified during the network-wide road safety assessment to be tackled through thorough inspections and planned remedial measures; it also requires attention to be paid to the legibility and detectability of road signs and road markings by human drivers and automated assistance systems. According to the European Commission, Romania has not correctly transposed yet these provisions. As a result, the Commission decided to send letters of putting in default France and Romania which have two months at their disposal to answer and correct the deficiencies mentioned by the Commission.In the absence of a satisfying answer, the Commission may decided to issue a reasoned opinion.
