AHK Romania welcomes the ordnance  regarding   the adjustment of  price for public works acquisition contracts

The Chamber of Commerce and Industry Romanian-German (AHK Romania) welcomes the effort in issuing the ordnance 15/2021 regarding the adjustment of price for public works procurement contracts, according to a press release sent on Friday.The AHK Romania representatives consider that this ordnance offers a viable solution for the unexpected fluctuations of construction materials prices, meant to ensure the execution in good conditions both of the contracts underway and the future ones. ''We appreciate the fact that the text of the ordnance took into consideration some suggestions sent by AHK Romania, such as the applicability of the ordnance including the sectorial works contracts signed under law 98/2016, as well as the extension of the domain of applicability for contracts of concession and framework agreements for works. Moreover, the final content keeps the mention of January 2021 as applicability of price adjustments, fact which is positive and favourable to the business environment in Romania'said Ciprian Neag, regional manager, Ludwig Pfeiffer Hoch - unde Tiefbau and coordinator of the working group constructions and public procurement in AHK Romania. Even so, the ordnance 15/2021 does not manage to cover certain aspects which could undermine the legislative effort by the reduction of the applicability area by comparison to what is necessary on the market. 'Thus, there is the possibility that future projects cannot be executed due to the lack of contractors, fact which will lead to major difficulties in the absorption of the EU funds, including those belonging to PNRR'' considers Sebastian Metz, general manager AHK Romania. The AHK Romania representatives focus on the necessity to reflect in the legislation some supplementary or modified points, with a view to defining a performing legislative framework and adapted to the best practices in the sector of constructions and public procurement. ''The legal provisions must take into consideration future investments ( especially those financed through European programmes  during the period 2021- 2027), avoinding the permanent amendment of the legislation, depending on the context and thus ensuring  its  predictable character. We are open to dialogue and we want to get involved in the definitio of a predictable legal framework, modern and adapted to the present requirements of the market'the press release says.AHK Romania is the official representative of the German economy and at the same time, the biggest bilateral chamber of commerce in Romania.
