ANRE certified Transelectrica as transport operator of the national electricity grid

The committee for the regulation of the National Authority for Regulation in Energy (ANRE) approved the certification of the National Company for Electrical Energy Transport Transelectrica, according to the model of property separation, as transport operator and system operator of the national electricity system, according to a press release of ANRE, ‘ Transelectrica had been certified by ANRE through order ANRE no.71/2014 as transport and system operator of the national electricity system, according to the model ‘ independent system operator’. Taking into consideration the opinion of the European Commission expressed on the occasion of this certification, according to which ‘ the ISO model is not the right one to be applied to Transelectrica’ and’ the separation of ownership rights in the state would constitute a more adequate option to assure the effective separation of the transport activities from the state interests as regards the delivery and generation of electricity’ and as a result of the legislative amendments due to the putting into effect of the emergency ordnance of the government no.86/17.12.2014, Transelectrica required ANRE to resume the procedure for the certification according to the model ‘ of ownership separation’ shows the press release. From the analysis of the legislative amendments, ANRE observed that Transelectrica fits the situation where the certification conditions can be analysed by comparison to the model of ownership separation. The decision, together with the documents which are at the basis of its approval, was notified at the European Commission. The European Commission examined the documents and issued the final agreement of 12/10/2015. This decision has no impact on the costs or tariffs paid by the end users, showed the ANRE officials. Through the directive 2009/72/EC of the European Parliament and the council of 13 July 2009 regarding the joint norms for the domestic market of electricity and annulment of the directive 2003/54/EC regulated the necessity of the effective separation of the production activities or supply of the transport and system activities. Thus, the separation of ownership is an effective way to solve the conflicts of interest which appear between producers, suppliers and transport and system operators. Transelectrica is owned by the ministry of economy (58.6%) while the production of energy is under the supervision of the ministry of energy.
