Changes to some normative acts regarding foreign citizens

November 7, 2024

The executive approved, on Wednesday, a draft law for the modification and completion of some normative acts in the field of foreigners, which establishes the possibility of revoking the visa or the right of temporary residence of seasonal workers, if the employer is liquidated, insolvent, does not carry out economic activities, does not has the debts paid or has been sanctioned recently, in the last 6 months, for certain contraventions.According to a press release from the Government, the draft law proposes the amendment and completion of OUG no. 194/2002 and OG no. 25/2014, to ensure the proper transposition of Directive 2014/36/EU on seasonal workers from third countries."Thus, the possibility of revoking the visa or the right of temporary residence of seasonal workers is established, if the employer is liquidated, insolvent, does not carry out economic activities, has not paid its debts or has been sanctioned recently, in the last 6 months, for certain contraventions. Also, the obligation of the seasonal worker to prove that he maintains the guaranteed minimum gross salary for the entire period of stay is eliminated," the release reads.Other changes refer to the application of professional training requirements only in the case of regulated professions, as well as to the establishment of compensations for the employee in case the visa or the right of residence are revoked for reasons not attributable to him, the quoted source states."Romania thus aligns itself with European requirements, ensuring better protection of seasonal workers from third countries," according to the press release. The draft law approved by the Government on Wednesday will be sent to the Parliament for debate and approval.
