ECHR rejects Calin Georgescu's request for provisional measures in case on annulment of presidential elections

The European Court of Human Rights (ECHR) on Tuesday rejected the request of Calin Georgescu on imposing provisional measures in the case in which he contests the annulment of the presidential elections in Romania.Georgescu had requested the adoption of provisional measures, in particular that the decision of the Constitutional Court be suspended and the electoral process be resumed with the second round. The ECHR rejected the request for provisional measures, as being outside the scope of Article 39 of the Regulation of the Court (provisional measures)", reads an ECHR press release.The Court imposes such provisional measures only in exceptional cases, when the plaintiffs would otherwise be exposed to an imminent risk of irreparable harm, the press release added.According to the ECHR, this decision does not influence a subsequent decision on the merits of the process.On November 24, 2024, the first round of the presidential elections in Romania took place, the second round of voting being scheduled to take place on December 8, 2024. Calin Georgescu ran for these elections and qualified for the second round of voting. On December 6, 2024, pursuant to Article 146 f) of the Romanian Constitution, the Constitutional Court of Romania (CCR) annulled the entire electoral process. The CCR then decided that the elections for the President of Romania should be resumed in full and reorganized by the Government at a later date.
