General Prosecutor’s Office published 2016 criteria for appointment of Augustin Lazar to prosecutor general. Former JusMin Raluca Pruna: I am publicly asking for Tudorel Toader’s resignation. He lied the whole nation

November 5, 2018

The General Prosecutor’s Office on Saturday published the criteria, conditions and documents requested by the Ministry of Justice for the procedure of appointment of Augustin Lazar as prosecutor general back in 2016. “After certain manipulative statements were made in the mass-media, we are showing what were the criteria, conditions and documents requested by the Ministry of Justice for the procedure of appointment in April 2016 of the prosecutor general to the top spot at the Prosecutor’s Office attached to the High Court of Cassation and Justice – which was a legal and transparent procedure,” reads a release of the General Prosecutor’s Office posted on the Website of the Public Ministry. The press release has been issued with two documents attached, an address dated in February 17 2016 of the Ministry of Justice sent to the General Prosecutor’s Office, as well as the “Criteria and calendar for the recruitment procedure for filling in the position of general prosecutor at the Prosecutor’ Office attached to the High Court of Cassation and Justice,” a document issued by the Ministry of Justice. In his address of February 17 2016, the Minister of Justice back then, Raluca Pruna, told First Deputy Prosecutor General Bogdan Licu to communicate to the prosecutors from the Public Minister that they had the opportunity to run for the office of general prosecutor. In the respective address there were also enumerated the documents necessary for the candidates: a CV and a letter of intent including a brief presentation of the candidates, details about his/her professional experience and qualities recommending him/her for the position. It was also mentioned the fact that the documents of the candidates had to be sent to the Ministry of Justice by email. The second document published on Saturday by the General Prosecutor’s Office enumerated the criteria announced in 2016 by the Ministry of Justice for the candidates to general prosecutor. *Integrity criteria: objectivity and impartiality in exercising his/her duties, always relying on the law, without giving up in front of pressure, observing the standards of conduct according to the profession’s dignity and honour, having high ethical standards and the capacity to make objective decisions, not being involved in any conflict that may contravene the public interest of carrying out justice or defending the general interests of the society. *Professionalism criteria: minimum 10-year experience as a judge or prosecutor; the “very good” score obtained at the most recent assessment; no disciplinary sanction in the past 3 years. *Criteria regarding the specific skills required by the position: capacity of organising the activity of the Public Ministry, for a good administration of justice; to have the vision of a manager, relevant professional experience, to be a good decision maker and responsible person, capacity to manage crisis situations, motivation, capacity of relating and communicating with others. The General Prosecutor’s Office release came in response to the statements made by the Minister of Justice, Tudorel Toader, who several times stated that the candidacy file submitted by Augustin Lazar was incomplete, as the “very good” score for his most recent assessment was missing.   Former JusMin Raluca Pruna: I am publicly asking for Tudorel Toader’s resignation. He lied the whole nation   Former Justice Minister Raluca Pruna is publicly asking for the current Minister Tudorel Toader’s resignation, claiming that he lied “the whole nation” on the procedure of appointing Augustin Lazar as General Prosecutor, in 2016, about which he said it was illegal. “I am publicly asking for Minister Tudorel Toader’s resignation. The General Prosecutor’s Office published the letter sent on February 17, 2016, by the Justice Minister to the Prosecutor’s Offices, in order to start the selection procedure for the General Prosecutor. The letter is clearly mentioning what the candidate’s file sent to MJ (Justice Ministry – e.n.) had to include: the CV and the motivation letter. Toader said that the mark of the last assessment was missing from the file and that there is a nolle prosequi ordinance. And he said that for these reasons, the procedure is illegal. I’ve waited for 10 days, I invited Minister Toader to clarify his accusations. He remained silent. All this time, the letter clarifying these things was at the Justice Ministry. Toader preferred to ignore it and lie the whole nation. I invite you all, ow that we have clarified the appointing procedure, to return to identifying the legal ground of the dismissal of the General Prosecutor. The name or the person doesn’t matter. Only institutions matter”, Raluca Pruna wrote on Facebook. The clarifications were made after the General Prosecutor’s Office published on the website of the institution, the documents showing the criteria, the conditions and the documents required by the Justice Minister to Augustin Lazar in April 2016, when he ran for the General Prosecutor, in order to prove that the procedure was legal. “Following the manipulative statements made in the media, we mention which were “The criteria, the conditions and the documents required by the Justice Minister for the appointing procedure of the General Prosecutor of the General Prosecutor’s Office attached to the High Court of Cassation and Justice, in April 2016 – a legal and transparent procedure”, is written on the website of the General Prosecutor’s Office. One of the documents presented on the website is the letter of the Justice Minister at that time, Raluca Pruna, and the list of criteria and the calendar of the recruiting procedure for the position of the General Prosecutor of the General Prosecutor’s Office attached to the High Court of Cassation and Justice. Pruna’s letter says a candidate’s file must include a CV and a motivation letter. The clarifications were made after Justice Minister Tudorel Toader stated that the General Prosecutor should have said if the accusations against him are true or not, mentioning that if he was the Justice Minister at that time, and received an uncomplete file, he would have rejected it. “He should have said if the statements made are true or not. I mean we are risking to made certain...
