George Simion: AUR starts actions to suspend Nicusor Dan

  George Simion, the leader of AUR (opposition), announced on Tuesday, that the party would start actions to suspend president Nicusor Dan, whom he accused of delaying to nominate a premier, in full political crisis.“We will start actions to suspend Nicusor Dan. Today and tomorrow we will bring good news from the extraordinary meeting of the National Leading Council of AUR,” George Simion wrote on Facebook.   The AUR leader asked the head of state to nominate a premier until the end of the week. “We summon Nicusor Dan to nominate a premier this week, according to constitutional obligations,” Simion added.   The announcement came on the same day when president Nicusor Dan spoke about political gridlock and said he feld it was not the time for him to get involved. “I wish we had a new government with full powers. I don't know when that could happen. I insist that parties should meet in the coming weeks to find a solution with a majority of votes. I often speak with party leaders.   “For now, mandates should be clarified by parties which should have talks with me. Now I feel I must get involved,” Nicusor Dan declared. The head of state also said he wanted the certainty there are 233 votes in Parliament to back a government. “For the time being there is not a majority able to back a government,”Nicusor Dan said.   Ways of suspending a president   Suspending the president is ruled by article 95 of the Constitution and can be initiated only in the case of “serious actions” by which the head of state infringed provisions of the Constitution.   The suspension must be initiated by at least a third of deputies and senators. Then the demand is sent to the Constitutional Court which issues a consulting approval. The parliament can consider the approval or not.   The president has the right to explain in Parliament the accusations against him. The suspension is decided by the Chamber of Deputies and Senate, in a joint meeting, with the vote of the majority MPs. That means at last 233 votes in the present Parliament.   In case the suspension is approved, the president is removed from duty and he is replaced by the Senate president. In no more than 30 days since suspension, a referendum for the dismissal of the president must be organized.   What happens at the referendum   At the referendum, electors answer “Yes”or “No” to the question: “Do you agree with the dismissal of Romania's president?” According to the present law, the referendum is valid if at least 30% of voters included on permenent election lists participate. Moreover, the result of the referencum is validated if valid options represent at least 25% of electors included on lists.   The dismissal of the president is approved if it meets most of valid votes expressed. Nicusor Dan was elcted president in the second round of presidential elections of May 18, 2025, when he obtained 6,168,642 votes, compared to 5,339,053 votes for George Simion.
