Gov't approves procedure on collection of royalties generated by surface concessions

February 10, 2022

The government approved on Wednesday, at the proposal of the Ministry of Development, Public Works and Administration (MDLPA), the procedure regarding the collection of the royalties generated by the activities of exploitation of the state's surface resources under concession."This normative act was needed because, although law provides that 80pct of the royalties generated by surface concessions go to local and county authorities and 20pct to the state budget, in the absence of any methodology, this law was not applied. According to the provisions of the Administrative Code, these revenues mainly concern the local and county authorities, and the proposed measures provide for the application of this right," specified Minister Cseke Attila, according to a press release of the MDLPA.According to the Administrative Code, the share of 40pct of the royalties generated by the concession of agricultural land will be transferred directly to the local budget, 40pct to the county budget and 20pct to the state budget, every month, quarterly, every semester or annually, according to the agreement in force.Regarding the royalties obtained by the exploitation of mineral resources, including carbonated or non-carbonated natural mineral waters, the exploitation percentages are distributed as follows: 35pct to the county budget on whose territory the exploitation activity is carried out, 45pct to the locality budget and 20pct to the state budget, every month, quarterly, every semester or annually, according to the agreement in force, said MDLPA.
