Ploiesti Court of Appeal suspends execution of Constitutional Court's decision on annulment of presidential election

A judge with the Ploiesti Court of Appeal admitted a request on the suspension of the Constitutional Court (CCR)'s decision of December 6, 2024 which annulled the presidential election.''Admits the request on the suspension of the execution of the contested administrative act. Suspends the execution of the Constitutional Court's Decision no. 32 of December 6, 2024, until the final resolution of the case. Admits the action for annulment. Annuls the Constitutional Court's Decision no. 32 of December 6, 2024. Orders the defendant to pay the plaintiff's legal costs in the amount of 70 lei, representing the judicial stamp duty. With the right to appeal within 5 days of the ruling'', according to the minutes of the ruling.The ruling can be appealed to the High Court of Cassation and Justice.   Former JusMin Toader: Constitutional Court's decisions are final and not subject to any appeal     The decisions of the Constitutional Court of Romania (CCR) are final and are not subject to any appeal, professor Tudorel Toader, former judge with the CRR and former minister of Justice, said.According to his statements, "the judge who pronounced such a decision [suspending the CCR decision on the annulment of the presidential election of November 24, 2024] managed to put his name into public discussion, even if through an inadmissible decision, outside the constitutional legal requirements".Former judge Cristi Danilet also stated that the decision of the Ploiesti Court of Appeal is “a judicial aberration”, because “a court cannot suspend or annul a CCR decision”.   In an initial reaction after the Ploiesti Court of Appeal decision, George Simion spoke about “returning to democracy and the rule of law.” “I support the return to democracy, to constitutional order and the rule of law: all of this means TURU2INAPOI!” George Simion wrote on Facebook.   On December 6, 2024, the Constitutional Court annulled the results of the first round of the presidential elections, won by Calin Georgescu, based on declassified documents received by the CSAT from the SRI, SIE, MAI and STS. The SRI reports speak of an operation prepared in advance, in favor of Calin Georgescu, and which has the “mode of operation of a state actor”.   BEC: The electoral process for the presidential elections scheduled for May 4 continues   The Central Electoral Bureau (BEC) announced on Thursday evening that the electoral process for the presidential elections scheduled for May 4 continues. “The activity of all offices continues on the basis of and for the execution of the measures provided for by the normative acts and administrative acts of a normative nature that target the current procedure for electing the President of Romania,” a BEC press release states.
