President Iohannis rejects appointment of Adina Florea as head of DNA

President Klaus Iohannis rejected on Wednesday the proposal for the appointment of Adina Florea as the chief prosecutor of the National Anticorruption Directorate. The  Presidential Administration specifies in a press release that in October Justice Minister Tudorel Toader sent to the president the following proposals appointing certain prosecutors in leadership positions:   * Adina Florea – Chief Prosecutorsof the National Anticorruption Directorate   * Florena-Esther Sterschi – Chief Prosecutor of the Section for Human Resources and Documentaries with the Prosecutor’s Office attached to the High Court of Cassation and Justice   * Elena Giorgiana Hosu – Deputy Chief Prosecutor of the Directorate for Investigating Organized Crime and Terrorism (DIICOT)   * Iuliana Nedelcu – Deputy Chief Prosecutor of the Judicial Section with the Prosecutor’s Office attached to the High Court of Cassation and Justice   * Antonia-Eleonora Constantin – Chief Prosecutor of the Judicial Section with the Prosecutor’s Office attached to the High Court of Cassation and Justice   “In accordance with the provisions of Art 54 in Law no. 303/2004 regarding the statute of justices and prosecutors, republished, with the subsequent amendments and completions, and given the reasons of the Constitutional Court Decision no. 358/2018, Romania’s President rejects the proposals tabled by the Justice Minister due to the prosecutor’s failure to comply with the legality conditions that need to be met so as to be appointed in a leadership position, namely the one provided for in Art 54 par (2), in relation to Art 48 Par (10) and (12) of Law no. 303/2004,” the Presidential Administration specifies.   Adina Florea, after Iohannis’ refusal to appoint her as the head Of DNA: It is Mr. President’s decision   Adina Florea stated for MEDIAFAX, after Klaus Iohannis refused on Wednesday the proposal to appoint her as the DNA Chief-Prosecutor, that it is the President’s decision and she refuses to comment on it. “I’m not making any comment, it is Mr. President’s decision, I have nothing to comment”, Adina Florea stated. Adina Florea currently is the Deputy Chief-Prosecutor of the Section for Investigating the Magistrates.   Toader, after Iohannis rejected Adina Florea’s appointment as the head of DNA: I am surprised that he finished reading and understanding so quickly   Justice Minister ironized President Klaus Iohannis’ decision to reject Adina Florea’s appointment as the head of DNA, declaring himself surprised that he finished reading and understanding so quickly. “I am surprised by the fact that he finished reading and understanding so quickly!”, Minister Toader stated for stiripesurse.ro.   Macovei: I urge the independent prosecutors to enroll in the contest for the DNA leadership. This is the only way to thwart PSD&ALDE plan to totally kneel justice   Former Justice Minister Monica Macovei says she urges the independent prosecutors to enroll in the contest for the DNA leadership, because “this is the only way to thwart PSD&ALDE plan to totally kneel justice”. “Rejecting Toader’s proposal for the DNA leadership is a natural gesture, after Adina Florea stated that «she never was an independent prosecutor», receiving a negative opinion from CSM. A prosecutor which is not and appreciates must not be independent cannot be the head of DNA, which investigates politicians independently and unbiased, no matter who they are”, Monica Macovei stated at in a press statement. Macovei mentions that prosecutors don’t have to comply with the requests of the Justice Ministry, in the investigation activity. “Toader will have to organize a new contest for the DNA leadership. Toader cannot select a puppet as the head of DNA if the anticorruption prosecutors who demonstrated that they can make unbiased investigations, that they can resist to pressure and be independent, will enroll in the contest. I urge them to do it. This is the only way to thwart PSD&ALDE plan to totally kneel justice”, MEP Monica Macovei added. She mentions that since Adina Florea was proposed as the head of DNA, being rejected today by President Iohannis, there have been issued the report of the Venice Commission, the CVM report and the resolution on the rule of law in Romania. “In all the documents, the emphasis is on the independence on justice. PSD&ALDE have bet on the fate of the country, pursuing their interests. Even the masquerade of the reshuffle of these days shows that PSD&ALDE do not propose ministers according to the competence criterion, but only to the one of obedience and loyalty towards the supreme leader Dragnea. This is exactly the reason for which justice and anticorruption must not accept the influence of the politicians who are sick for power and who want to get rid of files and convictions. At this moment, only the unbiased and independent prosecutors and judges can thwart PSD&ALDE’s plan”, Macovei also stated.
