Section for investigating magistrates, review after one month: 849 dossiers registered and 17 solved, of which one resulted in indictment and 16 were dismissed

The Section for investigating magistrates has registered 849 dossiers and has solved 17 of them – of which one resulted in indictment and 16 were dismissed – since it was set up one month ago. According to the Public Ministry, five prosecutors – appointed by the plenary of the Superior Council of Magistracy (CSM) on 22 October 2018 – are working within the Section. A total of 849 dossiers have been registered, concerning 642 judges, 675 prosecutors, and 625 persons investigated alongside magistrates. Of these dossiers, 714 were taken over from other prosecutor’s offices and 135 were newly registered with the Section. A total of 17 dossiers have been solved, one resulting in an indictment, and 16 being dismissed. The number of complaints lodged against the dismissal decisions taken before the Section was set up stands at 80, concerning 20 judges, 83 prosecutors and 51 persons investigated alongside magistrates. The activity was carried out by four operative prosecutors – coordinated by the chief prosecutor – six clerks, and five judicial police officers delegated to carry out the criminal prosecution activity starting on November 12. The Section became operational on October 23, as part of the Prosecutor’s Office attached to the High Court of Cassation and Justice (PICCJ). The Section for investigating criminal offences within the judiciary has the exclusive prerogative of criminally probing the offences committed by judges and prosecutors, including military judges and prosecutors and the members of the Superior Council of the Magistracy, the cases that pertain to its competence and that are handled by the National Anticorruption Directorate and other prosecutor’s offices, as well as the dossiers solved so far, being taken over by the Section.
